This Privacy Policy provides information on the collection, use, and sharing (collectively referred to ‘processing’ or ‘process’) of personal information by Realberry Real Estate Services, LLC and its affiliates (“Realberry”, “we” or “us”) in connection with your use of Realberry’s websites, including all subdomains, and social media pages that link to this Privacy Policy (collectively, “sites”), your interactions with Realberry when you call us, attend in-person meetings or our events, and in the context of other online or offline commercial and marketing activities. This Privacy Policy also explains the privacy rights you have in relation to these processing activities.

This Privacy Policy is incorporated into, and is part of, our Terms of Use available at https://www.realberry.com/terms-of-use/ which governs your access to and your use of the sites. This Privacy Policy does not cover data or information we receive from third parties, and it does not cover third party products and services.

By accessing the sites or by otherwise interacting with us, you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the sites or provide us with your personal information. Each time you use the sites, the current version of this Privacy Policy will apply. Accordingly, when you use the sites, you should check the date of this Privacy Policy (which appears at the top) and review any changes since you last reviewed the Privacy Policy.

INFORMATION WE COLLECT

We collect two types of information: “personal information,” which is information that can be used to identify you (such as your name, address, email address, or business contact details), and “aggregate information,” which is information that cannot be used to identify you (such as frequency of visits to the sites and your browser type).

INFORMATION YOU PROVIDE TO US

We collect personal information that you voluntarily provide to us when you use our sites or otherwise interact with us. For example, you may provide us with your business contact information and other professional and business details, and the content of your communication, when you choose to submit such information to us through email, by phone, an online form, or other method.

Additional examples include:

  • name and contact information such as email addresses, telephone numbers; and residential addresses;
  • company, employment and business data;
  • chat transcript data from sales and customer support calls and live chat sessions or interviews, including interactions with automated chatbots;
  • telephone and VoIP call recordings and transcripts, if you participate in a recorded or monitored call with us, along with related metadata (such as date, time, and participants);
  • unique IDs such as your mobile device identifier or cookie ID on your browser;
  • IP address and information that may be derived from IP address, such as geographic location;
  • information about a device you use, such as browser, device type, operating system, the presence or use of “apps”, screen resolution, and the preferred language;
  • behavioral data of the internet connected computer or device you use when interacting with the sites, such as advertisements clicked or viewed, sites and content areas, date and time of activities or the web search used to locate and navigate to a site; and
  • meeting scheduling details and related metadata (such as proposed and confirmed meeting times, invitees, and communication preferences); if you authorize it, limited access to calendar availability information to help suggest meeting times.

We may combine personal information collected from our websites, forms, events, communications, support interactions, and third‑party sources to create unified profiles and to reconcile identifiers across devices and platforms. We apply and, where feasible, propagate your opt‑out choices (for example, targeted advertising opt‑outs) to our integrated systems.

Certain online information about you or device information may originate from the use of cookies and similar technologies (for example, pixel tags and device identifiers) on our sites or sites of third parties. For more information on cookies and similar technologies, please see the “Cookies and Analytics” section below.

At or before the point of collection (for example, on web forms, in chat launchers, or when scheduling a meeting), we provide a concise notice linking to this Privacy Policy and to “Your Privacy Choices,” which identifies the categories of personal information collected, the purposes for collection, whether the information may be sold, shared, or used for targeted advertising, and the applicable retention period or criteria.

INVESTORS AND INVESTOR PORTAL USERS

We collect personal information, including sensitive personal information, from investors and potential investors, such as:

  • financial information collected in connection with our investment offerings;
  • Social security number, employer identification number, and date of birth;
  • information and data necessary to confirm your identity, verify accredited investor status, and comply with applicable laws and verification requirements (e.g., income level, accreditation documentation, etc.);
  • investment experience, preferences, portfolio characteristics, interests, objectives, targeted returns, and plans;
  • interest and engagement history regarding investment offerings; and
  • financial account information used to pay you distributions as returns on your investments.

When you use our investor portal, we collect your name and email address in order to set up your account on the portal.

INFORMATION WE AUTOMATICALLY COLLECT

When you use our sites, we automatically receive and collect information, including personal information, from your device.
This includes the following:

  • Information about your device, such as the operating system, hardware, system version, Internet Protocol (IP) address, device ID, and device language.
  • Your country and general location, time zone, and language used.
  • The specific actions that you take when you use our sites, including but not limited to the pages and screens that you view or visit and how you interact with our sites.
  • The time, frequency, connection type, and duration of your use of our sites.
  • Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded the email message. This includes engagement tracking in marketing and one to one sales emails (for example, open and click tracking via pixels and tracked links). If you opt out of marketing communications, we apply your choice across our email systems and suppress marketing related tracking where feasible.
  • Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below).
  • Pages you visited before or after navigating to our sites.

EMPLOYMENT

If we have collected your personal information in response to a job opening, you are giving us permission to use and retain your personal information for the purpose of evaluating your application for employment consideration for the specific position that you applied to, as well as other roles at Realberry. This personal information may be processed and stored by a third-party talent tracking solution provider as well as with vendors, consultants, and other service providers who need access to such information to carry out work relating to the recruitment process on our behalf.

AGGREGATE INFORMATION COLLECTED

Aggregate information is information that does not identify you. Aggregate information may be collected when you use our sites, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains personal information such that only aggregate information remains. We may collect, use, store, and transfer aggregate information without restriction.

COOKIES AND ANALYTICS

Like most websites, our sites may use “cookies.” Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our sites.

Our sites may use cookies for reasons including, but not limited to:

  • Analyze our web traffic using an analytics package.
  • Identify if you are signed in to the sites.
  • Test content on the sites.
  • Store information about your preferences, interests, and offering engagement history.
  • Recognize when you return to the sites.

Overall, cookies help us provide you with a better website and better sites by enabling us to monitor which pages, functions, and features you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This setting may prevent you from taking full advantage of the sites.

We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to our Website. These providers may collect online identifiers and usage information (for example, cookie IDs, IP address, and events) to help us understand how our sites perform and to improve content and features.

To disable Google Analytics, please download the browser add-on for the deactivation of Google Analytics provided by Google at http://tools.google.com/dlpage/gaoptout?hl=en. You have the option to opt out of Google’s use of cookies by changing your settings through Google Ad Settings via the Google advertising opt-out page.

You can also manage your preferences, including opting out of targeted advertising and certain analytics cookies and trackers, by clicking “Your Privacy Choices” in our site footer. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser. We honor browser-based opt-out signals where required by applicable law (for example, Global Privacy Control) for activities that may be considered a “sale,” “share,” or “targeted advertising."

OTHER WEBSITE TECHNOLOGIES

We use third-party services, such as Windfall, to help segment our sites’ audience and deliver and measure targeted advertising, including retargeting, based on users’ interactions with our sites and other contextual factors. These services process online identifiers (such as cookie IDs and IP addresses), device and browsing information (such as pages viewed, referring/exit pages, and timestamps), and inferences derived from this information to create or refine audience segments. We disclose these identifiers and internet/network activity to these third-party service providers to provide analytics and advertising services.

We also permit third parties and service providers to use online tracking technologies on our sites for advertising and data enrichment purposes, including to help manage and display advertisements, to tailor advertisements to your interests, or to send you reminders and notifications (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear on our sites, on other websites, or in our email communications. These technologies may also use tracking codes to identify you by your device information or internet protocol, or IP address, by connecting such information to information available from other sources, which may include your contact information and other personal information. To the extent these online tracking technologies are considered to be a “sale” or “sharing” of personal information (which includes targeted advertising, as defined under the applicable laws) under applicable privacy laws, you can opt-out of these online tracking technologies by adjusting privacy settings in your browser and on your devices, or following the instructions provided in this Privacy Policy.

We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our sites or social media and whether or not certain content, such as a video was viewed. We may work with a third party to collect and process this information for us, based on our instructions and in compliance with this Privacy Policy.

We may also participate in interest-based advertising. This means that you may see advertising on our sites tailored to how you browse, or you may see advertising for Realberry on other websites based on your browsing behavior across websites. Some websites where we may advertise belong to ad networks that use your web browsing history to choose which ads to display on their network websites; these ads include advertising for Realberry Other websites where you see our ads may use interest preferences that you have chosen on those sites, as well as registration and other information about you, to choose which ads to display to you. Some internet browsers, websites and mobile devices offer opt-outs for interest-based advertising. Please refer to the website that you are visiting, your browser and/or your device settings for additional information.

You can opt-out of receiving interest-based ads from third parties who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website (http://www.networkadvertising.org/choices/) and DAA website (http://www.aboutads.info/choices/).

HOW WE USE YOUR INFORMATION

In general, we collect information and personal information from you so that we can provide our sites, operate our business, and provide information that you request from us. This includes but is not limited to the following:

  • Communicate with you and respond to your inquiries;
  • Provide, operate, improve, maintain, and protect our sites. We log and review live chat and chatbot transcripts to provide support, improve our services, train our personnel, and address inquiries;
  • Analyze your activity on the sites. We develop inferences and profiles, such as interest segments or lead scores, based on your interactions with our sites and communications to personalize content, marketing, and outreach. Where we use your information for targeted advertising or disclose it to advertising partners, you may opt out via “Your Privacy Choices” or by using a supported browser-based opt-out signal that we honor as required by law;
  • Provide you with technical and other support;
  • Where permitted by law and with any required notice or consent, we place, receive, record, monitor, transcribe, and store telephone and VoIP calls for quality assurance, training, compliance, and customer support purposes;
  • Send you updates, marketing communications, and other information about Realberry, our properties, investment opportunities, and our sites;
  • Send you notices and alerts;
  • Conduct research, analytics, and monitor and analyze trends and usage;
  • Enhance or improve user experience, our business, and our sites, including the safety and security thereof;
  • Personalize our sites to you;
  • As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request;
  • Verify investor accreditation;
  • Enforce contracts, including investigation of potential violations thereof;
  • Detect, prevent, or otherwise address fraud, security or technical issues; and
  • Protect against harm to the rights, property or safety of Realberry, our users, or the public as required or permitted by law.

HOW WE SHARE YOUR INFORMATION

Like most companies, we share information, including personal information, in certain circumstances with third parties through operation of our sites and our business. Below we explain when that happens.

WITHIN REALBERRY

Your personal information may be shared throughout Realberry’s organization, including with our affiliate companies.

SERVICE PROVIDERS

We may transfer personal information to third parties for the purpose of providing the sites or operating our business. For example, we may share personal information with third-party services providers for analytics, event/campaign management, website management, information technology and related infrastructure provision, customer service, e-mail delivery, auditing, and other similar service providers in order for those service providers to perform business functions on behalf of Realberry.

TRANSFERS FOR A COMMERCIAL PURPOSE

We may share personal information with third parties to facilitate online advertising and use of other similar marketing technologies. These transfers support advertising, audience measurement, and data enrichment and may be considered a “sale,” “share,” or “targeted advertising” under certain state laws. You can opt out via “Your Privacy Choices” or by using a supported browser-based opt-out signal.

REQUIRED TRANSFERS

We may also transfer your personal information to third parties under the following circumstances: (i) to comply with a legal requirement, law, subpoena, judicial proceeding, court order, governmental request, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, asset sale, financing, reorganization, liquidation or dissolution of Realberry, including the evaluation thereof; (iv) when we believe it is necessary to protect the rights, property, or safety of Realberry or other persons, or (v) as otherwise required or permitted by law, including any contractual obligations of Realberry.

AS DIRECTED BY YOU AND WITH YOUR CONSENT

Except as otherwise provided in this Privacy Policy, we share personal information with companies, organizations or individuals outside of Realberry only at your direction or when we have your consent to do so.

STATE PRIVACY RIGHTS AND DISCLOSURES

In accordance with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary depending on your country or state of residence.

Right to Opt-Out of Cookies and Sale/Sharing Using Online Tracking Technologies Our use of certain online tracking technologies may be considered a “sale,” “sharing,” or “targeted advertising” under applicable privacy laws. Website visitors can opt out of being tracked by these third parties by clicking the “Your Privacy Choices” link at the bottom of our Website and selecting their preferences.

You may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). To download and use a browser supporting the GPC browser signal, click here: https://globalprivacycontrol.org/orgs. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

If you are a Nevada resident, you have the right to request that a company not sell your Personal Information for monetary consideration to certain other parties. This right applies even if your Personal Information is not currently being sold. To make such request, please send an email to privacy-requests@realberry.com with “Nevada Opt-Out of Sale” in the subject line and in the body of your message. We will provide the requested information to you via an email response.

Right to Limit the Use of Sensitive personal information

Residents of certain states have the right to limit our use of their sensitive personal information. We only collect sensitive personal information, as defined by applicable law, for the purposes allowed by applicable law or with your consent. We do not collect or process sensitive personal information for inferring characteristics about you. As a result, we do not offer the right to limit the use of sensitive personal information.

The Right to Access, Correct, and Delete personal information

You may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.

Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. Please note that in many situations we must retain all, or a portion, of your personal information in order to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.

Responding to Requests

We will respond to requests within the time frame permitted by the applicable law. Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

Identity Verification

We will take steps to verify your identity before processing your request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected personal information. We will only use the personal information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose.

Authorized Agents

You may also use an authorized agent to exercise your rights on your behalf. If you wish to use an authorized agent, we require that your authorized agent provide written proof to us that he or she is authorized to act on your behalf, and we may also require your authorized agent to verify his or her own identity. Right to Non-Discrimination

We will not discriminate against you for exercising your rights under applicable privacy law, such as denying you products and services, charging you different rates or prices including use of discounts or penalties, or suggesting or providing a different level of service or quality of products to you.

Right to Appeal

Under applicable law, if we decline to take the action requested pursuant to applicable law, we will notify you within 45 days from the receipt of your request and our justification for declining to take the requested action. You may have the right to appeal our refusal to a requested action, and instructions on how to avail yourself of the right to appeal will be included in any communication related to your request. We will reply to appeals informing you of any action taken or not taken in response to your appeal within 60 days of the receipt of your appeal.

If you no longer wish to receive our marketing and promotional communications, you may opt-out by following the instructions included in each communication.

CALIFORNIA AND TEXAS RESIDENTS

RETENTION OF PERSONAL INFORMATION

We retain personal information only for as long as is necessary for the purposes set out in this Privacy Policy, or as needed to provide the sites and operate our business. We will also retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable law), resolve disputes, enforce our agreements, and as otherwise described in our Privacy Policy.

CHILDREN'S PRIVACY

Our sites are not intended for use by children under the age of 18 and we do not knowingly collect personal information from children under the age of 18 in connection with the sites.

HOW WE PROTECT YOUR INFORMATION

We take the security of your personal information very seriously. We use reasonable administrative, physical, and technical safeguards to secure the personal information you share with us.
